By creating an account or using JakePrep (the "Service"), you agree to these Terms of Service ("Terms"). If you are a parent or guardian creating an account on behalf of a minor student, you agree to these Terms on behalf of yourself and that student. If you are a student aged 13 to 17 creating your own account, you agree to these Terms yourself, and you confirm that you understand JakePrep is a paid service that a parent or guardian must pay for before your free trial ends.
If you do not agree to these Terms, do not use the Service.
We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
Age requirement. JakePrep is not available to anyone under 13 years old. We enforce this at account creation.
Students aged 13–17. A student aged 13 to 17 may create their own JakePrep account and use the Service on a free trial. No payment is ever taken from a student. Before the free trial ends, a parent or guardian must create a parent account and link it to the student's account in order for paid access to continue. If no parent or guardian does so, the student's lessons pause; the student's account and their saved work are not deleted.
A parent or guardian may also create a student's account directly, as before. In that case the parent or guardian agrees to these Terms on the student's behalf and is responsible for the student's use of the Service.
All paid services are contracted for, and paid for, by a parent, guardian, or other adult aged 18 or over.
Adults. Users 18 and over may create their own accounts.
Account creation. You must provide accurate information when creating an account. Parent accounts manage billing and are linked to one or more student accounts. A student account may exist without a linked parent account during a free trial. Billing requires a linked parent account.
Account security. You are responsible for keeping your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at privacy@jakeprep.co if you believe your account has been compromised.
One account per user. You may not create multiple accounts or share accounts.
Contacting a parent or guardian. A student may ask us to contact their parent or guardian by giving us that person's email address. If a student does this, we will send that person an email introducing the Service and inviting them to create a parent account. We do not add that address to any mailing list or use it for marketing. If you receive such an email in error, you may disregard it.
JakePrep provides:
We reserve the right to modify, suspend, or discontinue features of the Service at any time with reasonable notice.
Access to SAT prep content is provided through an active subscription, through free months earned from tutoring hours, through a free trial, or through complimentary access we grant at our discretion. Your subscription rate is provided to you at the time of purchase. Subscriptions renew automatically each month until cancelled.
Free months from tutoring. For every 2 hours of live tutoring sessions you purchase, you receive 1 free month of platform access. Free months are applied automatically and do not roll over if your subscription is already active through a paid plan.
Free trial. New students receive a period of free access to the platform. When the trial ends, lessons pause unless a subscription or tutoring hours are active. Nothing is charged during or at the end of a free trial, and the student's work and scores are not deleted.
Live tutoring is billed at an hourly rate provided to you at the time of purchase. Rates may vary by account.
All payments are processed by Stripe. By providing a payment method, you authorize us to charge you for the fees described above. Your full card number is never stored by JakePrep — only a display reference (card brand and last four digits) is retained.
Your subscription will renew automatically at the end of each billing period. You will be charged the then-current subscription rate unless you cancel before the renewal date.
You may cancel your subscription at any time through your account settings or by contacting us at privacy@jakeprep.co. Cancellation takes effect at the end of the current billing period — you retain access through the date you have already paid for.
All fees are non-refundable except as required by applicable law. If you believe exceptional circumstances warrant a refund, contact us at privacy@jakeprep.co and we will consider your request at our discretion.
Sessions cancelled with less than 24 hours notice may be charged in full. If you need to cancel or reschedule, contact us at privacy@jakeprep.co as early as possible.
We will notify you at least 30 days before any increase to your subscription rate. Continued use after the effective date of a price change constitutes acceptance of the new rate.
All SAT preparation content on the Service — including lessons, question banks, drill content, practice tests, and session materials — is owned by or licensed to JakePrep and protected by copyright and other intellectual property laws. You may not copy, redistribute, or create derivative works from our content without our written permission.
Academic data you enter or generate through the Service (SAT scores, drill results, progress data) remains yours. You grant us a limited license to use that data to operate and improve the Service, consistent with our Privacy Policy.
If you provide us with feedback or suggestions, we may use them without obligation to you.
You agree not to:
Scheduling. Sessions must be scheduled in advance through the platform. Late cancellations and no-shows are subject to the cancellation policy in Section 5.
Recording. JakePrep does not record live tutoring sessions. You may not record sessions without the express consent of all participants.
Conduct. Both tutors and students are expected to conduct themselves professionally during sessions. We reserve the right to terminate sessions and accounts for abusive or inappropriate behavior.
Third-party video. Live sessions are conducted through Whereby, a third-party video platform. Your use of Whereby during sessions is subject to Whereby's terms of service. JakePrep is not responsible for technical issues attributable to Whereby's platform.
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR OUTCOME (INCLUDING SAT SCORE IMPROVEMENT) WILL RESULT FROM USE OF THE SERVICE. SAT PREPARATION OUTCOMES DEPEND ON MANY FACTORS OUTSIDE OUR CONTROL.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAKEPREP AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO JAKEPREP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
You agree to indemnify and hold harmless JakePrep and its owner from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Before initiating any formal dispute, you agree to contact us at privacy@jakeprep.co and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days.
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in New York, New York, or by video/phone if you prefer.
Exception — small claims. Either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies for small claims court jurisdiction.
Exception — injunctive relief. Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All claims must be brought on an individual basis only.
You may opt out of the arbitration agreement by sending written notice to privacy@jakeprep.co within 30 days of first creating your account. Your notice must include your name, email address, and a clear statement that you are opting out of arbitration. Opting out does not affect any other provision of these Terms.
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in New York, New York, and you consent to personal jurisdiction in those courts.
We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason at our discretion, with or without notice.
You may terminate your account at any time through account settings. Upon termination, your right to use the Service ends. We will handle your data as described in our Privacy Policy (including the 30-day recovery window before permanent deletion).
Sections 6, 10, 11, 12, 13, and 14 survive termination.
Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and JakePrep regarding the Service.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so in the future.
Assignment. You may not assign your rights or obligations under these Terms without our consent. We may assign our rights without restriction.
